YOU MAY BE ENTITLED TO A CASH PAYMENT FROM A CLASS ACTION SETTLEMENT IF YOU SCANNED YOUR FINGER FOR TIMEKEEPING PURPOSES WHILE WORKING FOR R & M FREIGHT, INC. IN ILLINOIS BETWEEN FEBRUARY 28, 2015 AND OCTOBER 27, 2020.

  • A proposed settlement has been reached in a class action lawsuit against R & M Freight, Inc. (“Defendant”) regarding a timekeeping system it used that allegedly required employees to scan their finger for timekeeping purposes, purportedly in violation of the law (“Settlement”). The case is Lumpkins v. R & M Freight, Inc., Case No. 2020-CH-02584, currently pending in the Circuit Court of Cook County, Illinois, Chancery Division (“Court”). The proposed Settlement is not an admission of wrongdoing by Defendant, which denies that it violated the law. The Court has not decided who is right or wrong. Rather, to save the time, expense, and uncertainty of litigation, the parties have agreed to settle the lawsuit.
  • The Court has granted preliminary approval of the Settlement and has conditionally certified the Settlement Class for purposes of settlement only. The Notice explains the nature of the class action lawsuit, the terms of the Settlement, and the legal rights and obligations of the Settlement Class Members. Please read the Notice carefully so that you can better understand your legal rights.
YOUR LEGAL RIGHTS AND OPTIONS IN THIS SETTLEMENT

ACCEPT THE SETTLEMENT

To receive payment from the Settlement Fund, you do not have to do anything. If the Court approves the Settlement, the Settlement Administrator will automatically send a check to your last known mailing address. For more information on the monetary benefits from the Settlement, see FAQ 6.

ASK TO BE EXCLUDED FROM THE CLASS BY MAY 3, 2024

You can exclude yourself from the class action and the settlement by submitting or mailing a written request that states you would like to be excluded from the settlement. If you choose to exclude yourself (opt out), you will not be included in the Settlement. You will receive no benefits and you will not release any claims you may have against Defendant regarding the allegations in this case ever again. Your request for exclusion must be submitted electronically using the “Submit an Opt Out” link above or postmarked by May 3, 2024. See FAQ 7 for more information.

OBJECT BY MAY 3, 2024

If you object to the settlement, and wish to file an objection rather than excluding yourself, you must submit your objection in writing to the Clerk of the Circuit Court for Cook County, Illinois. Your objection must be postmarked by May 3, 2024. If you exclude yourself from the Settlement, you cannot file an objection. See FAQ 7 for more information.
